These Terms govern your use of this website, the Kavach devices, the Kavach mobile applications, the Kavach app subscription and the Call & SMS add-on (together, the "Service"). By buying a device, creating an account or using the Service, you agree to these Terms.

1. Important safety limitations, please read

Kavach is not a medical device. It is not designed, tested or certified to diagnose, treat, monitor or prevent any medical condition, and must not be relied on as one.

The Service depends on things outside our control, including your phone's battery and settings, Bluetooth connectivity, mobile network and internet coverage, GPS availability and accuracy, third-party SMS and voice carriers, and whether your emergency contacts are able to see or answer an alert. We cannot and do not guarantee that any alert will be delivered, received, or acted upon.

Location data is approximate. GPS accuracy varies indoors, in dense urban areas and in poor weather.

You must keep your device charged, keep your emergency contact list accurate and current, and test the Service periodically using the test mode in the app.

2. Eligibility and your account

• You must be at least 18 years old to buy a device and hold an account.
• You are responsible for the accuracy of your account information and for keeping your credentials confidential.
• You are responsible for all activity under your account.
• You confirm you have the consent of each person you add as an emergency contact to share their number with us and to send them alerts, SMS and automated calls.

3. The device

The device is sold to you outright. Title passes on full payment and delivery. The device contains firmware which is licensed, not sold, and which we may update from time to time to fix defects, improve safety or maintain compatibility.

Devices are covered by a limited warranty of 12 months from delivery against defects in materials and workmanship, in addition to any rights you have under the Consumer Protection Act, 2019, which are not affected by these Terms. The warranty does not cover accidental damage, water ingress beyond the stated rating, unauthorised repair, or normal battery wear.

4. Subscription, pricing and payment

The Kavach app subscription and the Call & SMS add-on are sold as two separate recurring subscriptions, billed monthly or annually in advance. The add-on requires an active app subscription. Indicative launch pricing is shown on our pricing section and may change before general availability.

• Subscriptions renew automatically at the end of each billing period unless cancelled before renewal.
• You may cancel at any time from your account. Cancellation takes effect at the end of the paid period; we do not pro-rate part-periods except where the law requires it.
• If we increase the price of an existing subscription, we will give you at least 30 days' notice and you may cancel before the increase takes effect.
• Prices are exclusive of GST and other applicable taxes unless stated otherwise.
• Subscription activation codes may be redeemed once, and once redeemed are tied to a single Kavach account.

If your subscription lapses, alert delivery, location relay and the family map stop working. The device will no longer be able to notify your contacts. We will warn you by email and in the app before this happens.

5. Fair use of alerts

Alert triggers are unlimited and are never metered or charged per message. This is deliberate: we never want cost to make you hesitate before pressing the buttons.

That freedom depends on genuine use. Deliberately triggering false alerts, automating triggers, or using the Service to harass or alarm another person is a breach of these Terms and of our Acceptable Use Policy, and may result in suspension.

6. Intellectual property

The Kavach name, logo, device designs, firmware, applications, website and content are owned by Kavach Devices Private Limited or its licensors and are protected by Indian and international intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and firmware solely to operate your device.

You must not copy, modify, reverse engineer, decompile or create derivative works from the firmware or applications, except to the extent this restriction is prohibited by law.

7. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under Indian law, including under the Consumer Protection Act, 2019.

Subject to that, and to the maximum extent permitted by law:

• The Service is provided on an "as is" and "as available" basis.
• We are not liable for any failure or delay in delivering an alert caused by network, carrier, satellite, GPS, device, battery or third-party failure, or by an emergency contact not seeing or acting on an alert.
• We are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill.
• Our total aggregate liability arising out of or in connection with the Service is limited to the amounts you paid us for the device and subscription in the 12 months before the event giving rise to the claim.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms or the Acceptable Use Policy, if payment fails and is not remedied, or if we are required to by law. Where practicable we will give you notice and an opportunity to fix the problem first.

You may stop using the Service and close your account at any time. Sections that by their nature should survive termination will survive it.

9. Governing law and dispute resolution

These Terms are governed by the laws of India. Subject to the paragraph below, the courts at Pune, Maharashtra have exclusive jurisdiction.

Any dispute shall first be attempted to be resolved amicably through our grievance redressal process. If it is not resolved within 30 days, it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune, Maharashtra, and the language shall be English.

Nothing in this section prevents you from pursuing a complaint before a Consumer Commission under the Consumer Protection Act, 2019.

10. Changes to these Terms

We may update these Terms. If a change materially affects your rights, we will give you at least 30 days' notice by email or in the app. Continuing to use the Service after the change takes effect means you accept the updated Terms.
